Additional disclosures for Brazil residents
The following disclosures supplement other parts of this Privacy Policy with additional information to which residents of Brazil are entitled under the Lei Geral de Proteção de Dados Pessoais (Federal Law No. 13.709/2018, "LGPD"). In case of any conflict between this section and the rest of the Policy, this section prevails for residents of Brazil.
Controller and Data Protection Officer
For the purposes of the LGPD, Localised acts as the controlador (controller) of personal data collected through the site. Our third-party service providers (payment processors, carriers, hosting providers, analytics partners) act as operadores (processors) on our behalf.
You can contact our Data Protection Officer (Encarregado pelo Tratamento de Dados Pessoais) at privacy@localised.com.
Legal bases for processing (Art. 7 LGPD)
We rely on the following legal bases when processing your personal data:
- execution of a contract to which you are a party, or preliminary procedures related to a contract you have requested — used to process and deliver your orders, manage returns and refunds, and provide customer service;
- compliance with a legal or regulatory obligation of the controller — used to keep tax, accounting and consumer-protection records required by Brazilian law;
- legitimate interest of the controller — used for security, fraud prevention, service improvement and direct marketing of similar products to existing customers, balanced against your fundamental rights and freedoms;
- your consent — used for non-essential cookies and similar technologies, and for marketing communications where consent is required;
- protection of credit — where we share information with credit reference and fraud-prevention agencies, as permitted by the LGPD and the Brazilian Consumer Protection Code.
Your rights as a data subject (Art. 18 LGPD)
In addition to the rights described above, residents of Brazil have the right to request, free of charge and at reasonable intervals:
- confirmation of the existence of processing of your personal data;
- access to your personal data;
- correction of incomplete, inaccurate or outdated data;
- anonymisation, blocking or deletion of unnecessary or excessive data, or data processed in non-compliance with the LGPD;
- portability of your data to another service or product provider, subject to commercial and industrial secrecy;
- deletion of personal data processed on the basis of your consent, except where retention is permitted by Art. 16 LGPD (e.g. legal obligation, study by a research body, transfer to a third party, or exclusive use of the controller);
- information about the public and private entities with which we have shared your data;
- information about the possibility of not providing consent and the consequences of refusal;
- withdrawal of consent at any time, by the same means used to provide it;
- review of decisions taken solely on the basis of automated processing of personal data that affect your interests.
To exercise any of these rights, contact us at privacy@localised.com. We may need to verify your identity before responding.
International transfers of personal data
We may transfer your personal data outside of Brazil — including to the European Union, the United Kingdom and the United States — to our group companies, hosting providers, payment processors and other service providers that help us run the site. When we do so, we rely on one or more of the transfer mechanisms set out in Art. 33 LGPD, including transfers:
- to countries that provide an adequate level of personal data protection;
- subject to standard contractual clauses approved by the Autoridade Nacional de Proteção de Dados ("ANPD") under Resolução CD/ANPD No. 19/2024;
- with your specific and highlighted consent to the transfer; or
- to comply with a legal or regulatory obligation, to perform a contract to which you are a party, or for the regular exercise of rights in judicial, administrative or arbitral proceedings.
You can request more information about the safeguards in place for international transfers by contacting privacy@localised.com.
Retention
We retain your personal data for as long as needed to provide the services and, after that, only for the periods required to comply with tax, accounting and consumer-protection obligations under Brazilian law (in particular, the 5-year period set out in Art. 27 of the Consumer Defence Code and the 5-year statute of limitations in Art. 206, §5, I of the Brazilian Civil Code), or to defend our rights in judicial, administrative or arbitral proceedings.
Children and adolescents
Processing of personal data of crianças (children under 12) is carried out only with the specific and highlighted consent of at least one parent or legal guardian, in accordance with Art. 14 LGPD, and limited to what is strictly necessary to provide the requested service. Personal data of adolescentes (12–17) is processed in their best interest. We do not knowingly direct our products or marketing to children or adolescents.
Cookies and online advertising
Non-essential cookies are only set on your device after you provide consent through our cookie banner. You can withdraw consent at any time by reopening the cookie preferences from the site footer or by adjusting your browser settings, as described in the Cookies section above.
Complaints and the National Data Protection Authority
If you believe your rights under the LGPD have been violated, we encourage you to contact us first at privacy@localised.com so we can address your concerns. You also have the right to lodge a complaint with the Autoridade Nacional de Proteção de Dados (ANPD) at www.gov.br/anpd and, where consumer-protection matters are involved, with the relevant PROCON office or via www.consumidor.gov.br.
